VILLAGE OF BERRIEN SPRINGS REGULAR COUNCIL MEETING
 
Minutes of the Village of Berrien Springs Regular Council Meeting held on Monday, January 07, 2013.
President Pro-Tem Barry Gravitt called the council meeting to order at 7:00 p.m.
Present: President  Pro Tem Barry Gravitt, Trustees Jim Allred, Bob Caulpetzer, Lonna Johnson, Lance Parrish, Sandy Swartz, Attorney DeFrancesco and Clerk Sheri Kesterke.
Absent:  President Milt Richter
Also Present: Herald Palladium, Jeff Gates and Jill Mellen/Main Street Apartments.
 
All stood for the Pledge of Allegiance.
 
APPROVAL OF PREVIOUS MINUTES:
Minutes of the Regular Council Meeting held December 17, 2012.
*Moved by Jim Allred seconded by Lance Parrish to approve the minutes of the Regular Council Meeting held December 17, 2012 as presented.  Ayes, 6; Nays, 0.  Motion carried.
 
Minutes of the Special Council Meeting held December 20, 2012.
*Moved by Lance Parrish seconded by Lonna Johnson to approve the minutes of the Special Council Meeting held December 20, 2012.  Ayes, 6; Nays, 0.  Motion carried.

Main Street Apartments – PILOT Program - Draft Ordinance
Jeff Gates and Jill Mellen from TJ Acquisitions were present as Main Street Apartments Representative
 
Attorney DeFrancesco explained the ordinance to the council.  This is the second reading of the ordinance by the council.
 
*Moved by Jim Allred seconded by Bob Caulpetzer to adopt Ordinance #337 “An Ordinance to authorize the payment of an annual service charge in lieu of taxes for the renovation of a multi-family dwelling project serving low income or moderate income persons in accordance with the Michigan State Housing Development Authority Act 346 of the Public Acts of Michigan of 1966 as amended and matters related thereto”.  Roll call vote:  Lonna Johnson/Aye; Jim Allred/Aye; Lance Parrish/Aye; Sandy Swartz/Aye; Bob Caulpetzer/Aye; President Pro Tem Barry Gravitt/Aye.  Absent: President Milt Richter.  Motion carried.

Pay Bills
*Moved by Lance Parrish seconded by Bob Caulpetzer to approve the bills in the amount of $171,610.00.  Ayes, 6; Nays, 0.  Motion carried.
 
 Pay Invoice #105828 to Abonmarche as part of the Safe Routes to School project.  This is the 1st payment from the Village of Berrien Springs to Abonmarche for the project in which our ‘not to exceed’ total amount is $20,000.00. 
 
*Moved by Bob Caulpetzer seconded by Lonna Johnson to pay invoice #105828 to Abonmarche in the amount of $4,557.50 as part of the Safe Routes to School project.  Ayes, 6; Nays, 0.  Motion carried.
 
Pay Invoice #252-1674787 from The Bank of New York Mellon for the Berrien Springs Water 96 Project Pay Agent Fee
*Moved by Bob Caulpetzer seconded by Jim Allred to pay invoice #252-1674787 from The Bank of New York Mellon for the Berrien Springs Water 96 Project Pay Agent Fee in the amount of $150.00.  Ayes, 6; Nays, 0.  Motion carried.
 
Approve American Electric Power Co. Invoice #170-207739716 and forward to USDA RD as part of the 2012 Water & Sewer Improvements
*Moved by Lance Parrish seconded by Bob Caulpetzer to approve invoice #170-207739716 from American Electric Power Co. and forward to USDA RD for reimbursement as part of the 2012 Water & Sewer Improvements Project in the amount of $1,454.72.  Ayes, 6; Nays, 0.  Motion carried.
 
Approve Fleis & VandenBrink invoice #34813 in the amount of $18,244.63 and forward to USDA RD as part of the 2012 Water & Sewer Improvements Project.
*Moved by Lance Parrish seconded by Jim Allred to approve invoice #34813 from Fleis & VandenBrink in the amount of $18,244.63 and forward to USDA RD as part of the 2012 Water & Sewer Improvements Project for payment.  Ayes, 6; Nays, 0.  Motion carried.
 
Village web site quote
*Moved by Lance Parrish seconded by Lonna Johnson to approve the quote from Simple Updates to create a Village of Berrien Springs web site not to exceed $1,500 on the initial expenditure.  Ayes, 6; Nays, 0.  Motion carried.
 
PUBLIC PROPERTIES AND ORDINANCE – Sandy Swartz, Chair
The next committee meeting is scheduled for January 16, 2013.
 
Michigan Department of Natural Resources approves Five Year Park Plan
Chair Sandy Swartz informed the council that notice was received from the Michigan Department of Natural Resources that they approved the 2012-2017 Village of Berrien Springs Community Park, Recreation, Open Space and Greenway Master Plan.
 
FIRE – Bill Dustin & Milt Richter Village Representatives
The next Fire Board Meeting is scheduled for  January 23, 2013.

SHAMROCK PARK COMMITTEE – Jim Allred, Chair
The next committee meeting is scheduled for January 16, 2013.

MEDIC I budget meeting is scheduled for Thursday, January 10, 2013.

2013 Goals and Objectives
President Pro-Tem Barry Gravitt provided copies to the council of President Milt Richter and Clerk Sheri Kesterke’s Goals & Objectives for 2013.
 
 
Village Election Bills SB 810 & 811  
Clerk Sheri Kesterke informed the Council that she was notified that Bills 810 & 811 passed.  These bills move all September Village elections to the even November date.  Those up for election in 2013 will have their term extended until November of 2014.  Those receiving extended terms include President Milt Richter and Trustees Lonna Johnson, Lance Parrish and Sandy Swartz.

Trustee Lance Parrish expressed his frustration that the traffic light downtown was out of power.
